A resolution, a summary of which is published herewith, has been adopted on December 19, 2024, and the validity of the obligations authorized by such resolution may be hereafter contested only if such obligations were authorized for an object or purpose for which the Town of Pine Plains, in the County of Dutchess, New York, is not authorized to expend money or if the provisions of law which should have been complied with as of the date of publication of this Notice were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the publication of this Notice, or such obligations were authorized in violation of the provisions of the Constitution.

NOTICE IS HEREBY GIVEN that, pursuant to Section 121-59(G) of the Town of Amenia Zoning Code, a public hearing will be held by the Zoning Board of Appeals (ZBA) of the Town of Amenia, New York, on January 21st, 2025 at 6:00 PM.

Applicants Michael Levin and Laurence De Segonzac-Levin (the “Applicants”) seek an area variance from the Zoning Law with regard to Applicants’ request to subdivide a 62.896-acre parcel located at 189 Amenia Union Road, Tax Parcel # 132000-7266-(the “Property,”) previously amended by a lot line adjustment filed as Map # 12830). The Property is located in the Rural Agricultural (“RA”) Zoning District and is subject to a 10-acre minimum lot size requirement pursuant to the Zoning Law Dimensional Table in Section 121-11B. Applicants seek an area variance of 1.281-acres to create an 8.719-acre parcel (“Lot 1”) and a 53.177-acre parcel (“Lot 2”).

NOTICE OF RECEIPT OF TAX ROLL AND WARRANT

TAKE NOTICE, that I, Dawn Marie Klingner, the undersigned Collector of Taxes of the Town of Amenia, County of Dutchess and State of New York, have duly received the tax roll and warrant for the collection of taxes within the Town of Amenia for the year 2025, and that I will attend at 4988 Route 22, Amenia from January 2, 2025 to February 28, 9:00 o’clock in the forenoon to 2:00 o’clock in the afternoon on each day, excepting Fridays, Saturdays, Sundays and holidays for the purpose of receiving the taxes listed on the said roll.

TAKE FURTHER NOTICE, that taxes may be paid on or before February 28, 2025. On all taxes received after such date, there shall be an additional one percent for each additional month or fraction thereof thereafter until such taxes are paid or until the return of unpaid taxes to the county treasurer pursuant to law.

January to February 28, 0% (percent) penalty;

March 1 to March 31- 2% (percent) penalty;

April 1 to April 30 - 3% (percent) penalty;

May 1 to June 2 - 4% (percent) penalty;

June 1 until settlement with County Treasurer, 5% (percent).

In addition, after May 15, a fee of $2.00 will be added for each parcel.

RESOLUTION

NO. 130 of 2024

RE: INTRODUCING PROPOSED “LOCAL LAW NO. ___ OF THE YEAR 2024, TO AMEND CHAPTER 121 OF THE TOWN CODE, ‘ZONING’, TO REGULATE ADULT-USE CANNABIS RETAIL DISPENSARIES”

WHEREAS, the Town Board of the Town of Amenia previously opted-out of allowing the licensing and establishment of adult-use cannabis retail dispensaries within the Town of Amenia by adoption of Local Law No. 1 of 2022; and

WHEREAS, the Town Board has now determined that adult-use cannabis retail dispensaries should be permitted within the Town of Amenia and has introduced a local law to repeal Local Law No. 1 of 2022 and allow adult-use cannabis retail dispensaries within the Town of Amenia; and

WHEREAS, it has come to the attention of the Town Board that Chapter 121 entitled “Zoning” is in need of being amended in order to regulate adult-use cannabis retail dispensaries to protect neighboring properties and the health and welfare of the community and provide provisions that govern the time, place and manner of adult-use cannabis retail dispensary operations; and

WHEREAS, the Town Board determines that the proposed action is a Type I Action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as “SEQRA”), which requires that a Full Environmental Assessment Form (FEAF) be completed prior to adoption; and

WHEREAS, the Town Board has reviewed Part 1 of the FEAF completed by the Town’s Planning Consultant, a copy of which is annexed hereto and made a part hereof; and

WHEREAS, the proposed Local Law is an action for which there are no other involved agencies and, therefore, the Town Board is, by default, the Lead Agency for this Action.

NOW, THEREFORE, BE IT RESOLVED as follows:

1.The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein.

2.The Town Board hereby introduces for consideration of its adoption proposed “Local Law No. ____ of the Year 2024, to Amend Chapter 121 of the Town Code, ‘Zoning’, to Regulate Adult-Use Cannabis Retail Dispensaries” in the form annexed hereto.

3.The Town Board has determined that the enactment of the aforementioned Local Law is a Type I Action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as “SEQRA”) and reserves its obligation to make a determination of significance until after the public hearing.

4.The Town Board is the only agency having approval authority for the adoption of this Local Law and is therefore Lead Agency for the purpose of SEQRA.

5.The Town Board hereby schedules a Public Hearing regarding the proposed adoption of the annexed Local Law for 7:00 P.M., on the 16th day of January, 2025, to be held at Town Hall, 4988 Route 22, Amenia, New York, and the Town Clerk is directed to post a Notice of Public Hearing in the Town’s official newspaper, the Millerton News, and on the sign board maintained by the Town Clerk in Town Hall not less than ten (10) days prior to said public hearing date, and that such notice shall be in the following form.

6.The Town Board further directs the Town Clerk to act as follows with respect to the proposed Local Law:

a. to serve a copy of this Resolution, the annexed proposed Local Law, Part 1 of the Full Environmental Assessment Form and Notice of Public Hearing to the municipal clerk of each abutting municipality not less than ten (10) days prior to said public hearing; and

b.to serve a copy of this Resolution, the annexed proposed Local Law and Part 1 of the Full Environmental Assessment Form to the Dutchess County Department of Planning and Development for advisory review in accordance with §§ 239-l and 239-m of the General Municipal Law; and

c.to serve a copy of this Resolution, the annexed proposed Local Law and Notice of Public Hearing to the Town of Amenia Planning Board for its review and recommendation prior to said public hearing.

Winters announces run for Amenia town supervisor

Paul Winters announced his candidacy for Amenia Town Supervisor on Friday, Jan. 3.

AMENIA — Accepting a request from the Amenia Town Republican Committee, councilmember Paul Winters announced on Friday, Jan. 3, his candidacy for the position of town supervisor. The election will be held in November.

Winters has served several town committees and other local volunteer endeavors. Since January of 2024, Winters has been serving as a councilmember on the Town Board.

When Seth Rogovoy, acclaimed author, critic, and cultural commentator of “The Rogovoy Report” on WAMC Northeast Public Radio, was asked to lead a talkback at The Triplex in Great Barrington following a screening of the Bob Dylan biopic “A Complete Unknown,” he took on the task with a thoughtful and measured approach.

“I really try to foster a conversation and keep my opinions about the film to myself,” said Rogovoy before the event on Sunday, Jan. 5. “I want to let people talk about how they felt about it and then I ask follow-up questions, or people ask me questions. I don’t reveal a lot about my feelings until the end.”
